Article 1
Aestimo: the sole proprietorship Aestimo, registered in Epe, the Netherlands, Chamber of Commerce number 99537370.
Client: the natural person or legal entity entering into an agreement with Aestimo for the delivery of a Service.
Service: the advisory and analysis services offered by Aestimo, including valuations, bidding advice, scenario analysis, risk assessments, purchase agreement reviews and other related services as described on the Website and in the package descriptions.
Agreement: the arrangement between Aestimo and the Client for the delivery of a Service, established upon acceptance of the assignment and receipt of payment.
Report: the market value report, bidding advice, or other written deliverable that Aestimo provides to the Client as part of the Service.
Website: www.aestimobidding.nl and all associated subdomains.
Article 2
These terms apply to all offers, quotations, assignments and agreements between Aestimo and the Client.
By placing an order or using a Service, the Client accepts these terms.
Deviations from these terms are only valid if agreed in writing.
Aestimo reserves the right to amend these terms. The most recent version is always available on the Website.
Article 3
All offers and prices on the Website are non-binding unless stated otherwise.
The Agreement is formed when the Client selects a package, provides the required information, payment is received in full, and Aestimo confirms the assignment.
Aestimo reserves the right to refuse an assignment without stating reasons.
Article 4
Aestimo offers the following core packages:
Value & Insight (€245 incl. VAT). Market value assessment, comparable properties, local market dynamics, value report (PDF) and personal contact.
Strategic Bid (€395 incl. VAT). All elements of Value & Insight, plus concrete bidding advice, three scenarios (cautious, realistic, aggressive) and a risk assessment tailored to the Client's financial situation.
Secure Bid (€595 incl. VAT). All elements of Strategic Bid, plus a professional bid letter, purchase agreement review for unfavourable clauses, risk identification in contract terms, and priority handling. See Article 5(2) for the payment arrangement.
Aestimo also offers additional services, including the International Service (€695 incl. VAT, English-language with full process guidance and bid letter), a professional bid letter add-on (€125 incl. VAT) and express service (+€75 incl. VAT, delivery within 24 hours). Current prices and specifications are on the Website.
All prices stated include 21% VAT, unless stated otherwise.
Article 5
Payment is due in advance, before the Service begins. Aestimo will only commence work after payment is received.
Secure Bid payment arrangement (price guarantee). For the Secure Bid package, a split payment applies. The Client pays €395 upfront (equal to the price of the Strategic Bid package). Upon acceptance of the bid by the seller, the Client pays an additional €200.
If the bid is not accepted, the Client owes only the €395 paid upfront. The additional €200 invoice will not be charged, or, if already paid, will be credited.
Payment is possible via the payment methods indicated on the Website or in the order confirmation (Mollie).
In case of late payment, Aestimo is entitled to suspend execution of the Service.
In case of payment arrears, the Client is automatically in default and Aestimo is entitled to charge statutory interest and extrajudicial collection costs.
Article 6
The Client has the right to dissolve the Agreement within 14 days of its formation without stating reasons (right of withdrawal), in accordance with the Dutch Distance Selling Act.
Exception. If the Client, when placing the order, expressly consents to immediate execution of the Service and waives the right of withdrawal, this right expires as soon as Aestimo begins execution. This consent is explicitly requested in the order confirmation.
If the right of withdrawal applies and the Client dissolves in time, the amount paid will be refunded within 14 days, less a proportional fee for work already performed.
Article 7
Aestimo performs the Service to the best of its knowledge and ability, based on professional data sources and personal analysis.
Delivery time is aligned with the Client's bidding deadline. For express orders (+€75), delivery is within a maximum of 24 hours.
Aestimo is entitled to outsource execution in whole or in part to third parties, without affecting the quality of the Service.
The Client is responsible for providing correct information in a timely and complete manner. Aestimo is not liable for consequences of incorrect or incomplete information provided by the Client.
Article 8
Aestimo's advice is based on professional property data and personal analysis. The advice constitutes a substantiated estimate and is expressly not a valuation, not a guarantee of winning a bid, and not a guarantee of achieving any particular result.
The Client is at all times personally responsible for the final bidding decision. Aestimo acts as an independent bidding strategist and not as a buyer's agent, appraiser or legal advisor.
The purchase agreement review (in the Secure Bid package) concerns the identification of potentially unfavourable clauses and risks. This is expressly not legal advice and does not replace review by a lawyer or notary. Aestimo advises the Client, when in doubt, to always consult a legal specialist.
The Report and advice are a snapshot in time. Aestimo is not responsible for market changes, changes in property value or other circumstances occurring after delivery.
Article 9
Aestimo's liability is limited to the amount the Client has paid for the relevant Service.
Aestimo is not liable for indirect damage, consequential damage, lost profits or missed opportunities, including but not limited to not winning a bid, a bid that is too high or too low, or damage arising from decisions the Client has taken in response to the advice.
Aestimo is not liable for damage resulting from incorrect or incomplete information provided by the Client, inaccuracies in the data sources used, or force majeure.
Article 10
All reports, advice, analyses and other documents that Aestimo provides to the Client as part of the Service are and remain the intellectual property of Aestimo.
The Client receives a personal, non-transferable right of use for personal use. The Client may not copy, publish, resell or make available to third parties the documents provided, in whole or in part, without prior written consent from Aestimo.
Article 11
Aestimo processes the Client's personal data in accordance with the General Data Protection Regulation (GDPR). The legal basis for processing is the performance of the Agreement.

Article 12
Both parties are bound to confidentiality regarding all confidential information obtained in connection with the Agreement. This obligation also applies after termination of the Agreement.
Aestimo will treat the Client's financial situation, bidding strategy and other personal data confidentially.
Article 13
Complaints about execution of the Service must be reported in writing to Aestimo within 14 days of delivery, via info@aestimobidding.nl.
Aestimo will assess the complaint substantively within 14 days of receipt and inform the Client of the outcome.
Filing a complaint does not suspend the Client's payment obligation.
Article 14
If the Client wishes to cancel the assignment after the Service has started (and the right of withdrawal has expired), Aestimo is entitled to charge for costs already incurred and work already performed.
In the case of full cancellation before work has started, the amount paid will be fully refunded.
Article 15
In the event of force majeure, Aestimo is not obliged to fulfil any obligation. Force majeure includes, among other things: technical failures, unavailability of data sources, illness, government measures or other circumstances beyond Aestimo's control.
In the event of prolonged force majeure (more than 30 days), both parties have the right to dissolve the Agreement, without obligation to pay damages.
Article 16
Dutch law applies to all agreements between Aestimo and the Client.
Disputes are preferably resolved by mutual agreement. If this does not lead to a solution, the competent court in the Gelderland district has jurisdiction.
Article 17
If one or more provisions of these terms and conditions prove to be void or voidable, the remaining provisions will continue in full force and effect. The void provision will be replaced by a provision that most closely matches the intent of the original.
Aestimo is entitled to amend these terms. Amendments will be announced at least 30 days before entry into force via the Website. For ongoing agreements, the terms in force at the time of formation will continue to apply.
